Novo Nordisk Whistleblower Set for $8.4 Million Settlement Share

A false claims whistleblower is entitled to an 18% share of a $46.5 million False Claims Act settlement between Novo Nordisk Inc. and the government involving improper marketing of diabetes medication Victoza, a Washington federal court said.

This amount, as opposed to the statutory minimum 15%, was appropriate because Elizabeth W. Kennedy’s disclosure of fraudulent conduct to the government was “informative, significant, and caused her to experience adverse consequences,” Judge Reggie B. Walton of the U.S. District Court for the District of Columbia said Tuesday. The 18% share of the settlement amounts to roughly $8.37 million.
